1. Eligibility

Genqiz service is intended for users of all ages. For children under 13, Genqiz does not require parental consent; please consider this before use. We have designed our system to allow children to use Genqiz without collecting personally identifiable information, except for persistent identifiers used to recognize Genqiz users for customer care and necessary communication purposes. By using the Service, you declare and warrant that: (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; and (c) your use of the Service does not violate any applicable laws or regulations. 

2. Your Genqiz Account and Data

If you register an account with our service, it is your responsibility to maintain the security of both your account and data. You are fully accountable for all activities taking place under your account. Promptly inform Genqiz of any unauthorized use of your data, account, or any other security breaches. Genqiz disclaims legal responsibility for any of your actions or oversights, including any damages resulting from such actions or oversights. Occasionally, Genqiz may impose storage limits on your data or implement other measures deemed appropriate for service management. Genqiz may also revise its policies on providing commercial content or displaying advertisements, and such changes may occur without prior notice.

3. Content and Prohibited Activities as well as Contributor's Responsibilities 

If you create puzzles, question, documents.... provide comments through the discussion box, post documents on the Service, share links on the Service, or contribute any material through the Service (any such material, "Content"), you are entirely responsible for the content and any harm arising from that content. This applies regardless of whether the mentioned content consists of text, graphics, audio files, computer software, or any other format that Genqiz stores data in or not. You are also entirely responsible for ensuring that you have the legal right to use any information and content. Genqiz assumes no responsibility for damages caused by your actions, errors, omissions, or negligence in relation to the content you post on Genqiz.

4. Types of content that are illegal or prohibited to be posted on or through the Service

Genqiz Service is intended for educational purposes. Here are examples of the types of content that are illegal or prohibited to be posted on or through the Service. Genqiz has the right to suspend or terminate your access to Genqiz if you post illegal or prohibited content. Genqiz may further investigate and take appropriate legal actions against anyone, at Genqiz's sole discretion, who violates these terms, including but not limited to removing offending content from the Service and terminating the accounts of those violators. Prohibited content includes, but is not limited to, content that Genqiz has the sole discretion to determine:

• Clearly violates and encourages racial discrimination, prejudice, hatred, or physical harm of any kind towards any group or individual.
• Harasses or advocates the harassment of others.
• Exploits or encourages the exploitation of human beings in a sexual or violent manner.
• Contains anything sexually suggestive, nude images unrelated to legitimate art, medicine, or other genuine educational fields, describes or glorifies excessive violence without educational value, or constitutes offensive material.
• Publicly discloses information that causes or creates a risk of privacy or security for anyone.
• Includes information about others that you have posted without their consent.
• Violates the privacy, publicity, copyright, trademark, contract, or any other rights of any person.
• Constitutes or promotes information that you know is false or misleading or encourages illegal, abusive, threatening, defamatory, or libelous activities or behavior.
• Constitutes or promotes the illegal or unauthorized copying of copyrighted works of others.
• Takes passwords or personal identification information for commercial or illegal purposes from other users.
• Involves transmitting "spam," "chain letters," or unsolicited mass mailing, instant messaging, or "spamming."
• Continues or promotes any criminal activity or enterprise or provides information on illegal activities, including but not limited to making or purchasing illegal weapons, violating someone's privacy, or providing or creating computer viruses.

5. Illegal or prohibited activities on the Service

Genqiz has the authority to investigate and take appropriate legal actions against anyone, at the discretion of Genqiz, who violates these terms. This may include reporting individuals to law enforcement or national security agencies. Prohibited activities include, but are not limited to:

• Engaging in criminal or harmful activities, such as child pornography, fraud, trafficking in obscene materials, drug trafficking, gambling, harassment, stalking, spamming, sending viruses, or any other harmful files, as well as violating copyright, patent, or trade secret laws.
• Tampering with or attempting to tamper with any technology or security software that is part of the Service, or encouraging and assisting others in doing so.
• Organizing or encouraging violent behavior.
• Impersonating or attempting to impersonate other users, individuals, or organizations.
• Unauthorized use of another user's account, username, or password, or disclosing your password to any third party or allowing unauthorized access to your account.
• Misusing information obtained from the Service to harass, abuse, or harm others, or attempting to do so.
• Involvement in activities related to the use of viruses, bots, worms, or any computer code, file, or program that disrupts, destroys, or limits the functionality of any software or computer hardware, or allows unauthorized access to computers or computer networks.
• Any use of automated systems, such as scripts, to create or post Content.
• Interfering, disrupting, or excessively burdening the Service or networks or services connected to the Service.

6. By submitting Content, you affirm and guarantee that:

• The act of downloading, copying, and utilizing the Content will not infringe upon the intellectual property rights, including but not limited to copyrights, patents, trademarks, or trade secrets of any third party.
• If your employer holds rights to the intellectual property you have created, you have either (i) obtained permission from your employer to publish or provide the Content, including any software, or (ii) secured a waiver from your employer relinquishing all rights to the Content.
• You have fully adhered to all licenses from third parties associated with the Content and have taken all necessary measures to convey any required terms to end-users.
• The content does not contain or introduce any viruses, worms, malicious software, Trojan horses, or any other harmful or destructive elements.
• The content is not spam and does not contain unethical commercial content or unwanted material intended to divert traffic to third-party websites or enhance rankings on search engines, or to facilitate unlawful activities (such as fraud) or mislead recipients about the source of the material (such as spoofing).
• The content is not defamatory or libelous and does not violate the privacy or publicity rights of any third party; and
• In the case of content containing computer code, it must accurately categorize and/or describe the type, nature, functions, and effects of the material, whether required by Genqiz or otherwise.

7. Genqiz's Rights in Using Content from Free Services

Users who utilize Genqiz as free users (non-paying users) and submit content to be included in the Service (for example, by creating a quiz) hereby grant Genqiz a global, perpetual, royalty-free license (with the right to sublicense) to utilize, reproduce, process, adapt, modify, publish, transmit, display, and distribute the submitted content on any existing or future media or distribution platforms. Genqiz or its collaborating companies and individuals may utilize such content without the obligation to provide compensation for the content you submit, post, or provide through the Service.

8. Public User Content

If you opt to share your User Content on Genqiz's publicly accessible user content, you are granting Genqiz an everlasting (or, as long as current law permits), non-exclusive, sublicensable, transferable, royalty-free, irrevocable, fully paid, universal license to commercially utilize, use, duplicate, present to the public (e.g., perform or display), publish, translate, alter, create derivative works, and disseminate your public user content through any medium, either on its own or combined with other content or materials, in any form, and by any means, methods, or technologies, whether presently known or developed in the future. Aside from the specific rights granted herein, you retain ownership of all rights, including intellectual property rights, in your User Content.

9. Payment, Cancellation, Upgrade

In general, you have the option to purchase a premium subscription directly from Genqiz on our website. This section of the Terms applies specifically to cases where you have chosen to subscribe to one of our premium plans directly through the website.

By agreeing to these terms, you confirm that the information provided during registration, your payment details (if applicable for a premium subscription plan), and any other information submitted to us are accurate, truthful, and complete. You also commit to keeping this information up-to-date to avoid any interruption or termination of your subscription. If there are inaccuracies or changes needed in the information you provided, you should either revisit the login screen or edit the details in your account settings. Additionally, you pledge that no unauthorized person will use or access your account, your Genqiz subscription, or exercise the rights granted to you under the Agreement in any unauthorized manner

10. Payment and Subscription Duration

Payment for all premium subscription plans must be made in full before each subscription term. Once a premium subscription plan is paid for, it cannot be canceled, and no refunds will be issued.

You will be billed before obtaining access to your premium subscription plan. Upon the conclusion of the current subscription term, your premium subscription plan will automatically renew, and you will be charged for the subsequent subscription term using the payment details you provided.

Failure to make a timely payment for your premium subscription plan gives Genqiz the right to suspend your account or disable features associated with the premium subscription plan.

11. Price Adjustments and New Subscription Plans

Genqiz retains the right to adjust the prices for premium subscription plans. Should such adjustments affect you, they will become effective at the commencement of your next subscription period. Your continued use of Genqiz services indicates your acknowledgment and acceptance of the modified prices. If you disagree with the price adjustments, you are entitled to reject them by canceling your subscription before the upcoming renewal.

Refunds will not be issued in case of a reduction in the price of a premium subscription plan, the introduction of subsequent promotional rates, or modifications to the content or features of the subscription plan.

Genqiz may opt to modify or replace our subscription plans. In the event of changes or replacements to the subscribed plan, your subscription will automatically apply to the corresponding plan at the original price unless you opt to upgrade your subscription.

12. Free Trial Registration

We may, at our discretion, provide you with a Trial subscription. We reserve the right to terminate the Trial and suspend your account if we determine that you do not meet the eligibility criteria.

For some Trials, we may request your payment details to commence the Trial. In such instances, your Trial will automatically transition into a paid subscription for the chosen subscription plan starting from the first day following the conclusion of the Trial Period, provided you opt to convert your plan to a paid subscription. The payment details you provided at the beginning of the trial will be used to calculate charges for you. If you do not wish to continue using your selected subscription plan by converting the Trial into a paid subscription, you must exercise your cancellation right before the end of the Trial Period.

13. Responsibility of Service Visitors

Genqiz does not conduct a comprehensive review of all materials posted on the Service and, therefore, cannot assume responsibility for the content, usage, or consequences of such materials. By providing the Service, Genqiz does not declare or imply an endorsement of the posted material, nor does it assert that the material is accurate, beneficial, or free from harm. It is your responsibility to take appropriate precautions to safeguard yourself and your computer system against viruses, worms, Trojan horses, and any other harmful or destructive content. The Service may contain content that is offensive, inappropriate, or objectionable, and may also include inaccuracies, typographical errors, or other mistakes. Additionally, the Service might feature material that breaches privacy or publicity rights, infringes upon intellectual property or other proprietary rights of third parties, and any download, copy, or use of such material may be subject to additional terms, whether explicitly stated or not. Genqiz explicitly disclaims any liability for any damages arising from your use of the Service or any downloads made by visitors of posted content.

14. Content Published on External Websites

We have not examined and cannot examine all content, including software, available through websites linked from Genqiz. Genqiz lacks control over such external websites and bears no responsibility for their content or utilization. Linking to a non-Genqiz website or webpage does not signify or imply an endorsement of that specific site or page. It is your responsibility to implement necessary precautions to safeguard yourself and your computer system from viruses, worms, Trojan horses, and other harmful or disruptive content when engaging with non-Genqiz websites. Genqiz explicitly disclaims any responsibility for damages arising from your use of non-Genqiz websites and webpages.

15. Copyright Infringement and DMCA Policy

Since Genqiz expects others to respect its intellectual property, it also respects the intellectual property of others. If you believe that content on or linked to by Genqiz violates your copyright, please notify Genqiz via email at [email protected]. Genqiz will promptly respond to such notifications by removing the infringing material or disabling links to it, as required or deemed appropriate. If a user is found to infringe Genqiz's or others' copyright or intellectual property rights, Genqiz may, at its discretion, terminate or deny access to the Service without any obligation to refund previously paid amounts.

16. Changes 

Genqiz reserves the right to make changes to the Service, encompassing all available content and these Terms and Conditions, without the need for prior notification. You are obligated by any such revisions or alterations, encompassing those affecting these Terms and Conditions, hence it is recommended to regularly review these Terms and Conditions.

17. Genqiz's Limited Warranty, Providers, and Genqiz's Licensors

Unless otherwise explicitly stated, all content posted on or available through the Service is provided "as is," and Genqiz, its providers, and its licensors make no representations or warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, ownership, or non-infringement. You understand and agree that you download or obtain content or services through the Service at your own discretion and risk, and Genqiz, its providers, and its licensors shall have no legal liability or responsibility for any damage to your computer system or data arising from the download or use of such content or services.

18. Limitation of Legal Liability for Genqiz, Providers, and Genqiz's Licensors 

Unless explicitly stated otherwise, in any circumstance, Genqiz, its providers, or licensors of Genqiz will not be legally responsible to you or any other party for any direct, indirect, special, consequential, or exemplary damages, irrespective of the basis or nature of the claim, arising from the usage of the Service or the content within the Service or any linked super-websites. This includes, but is not limited to, any lost profits, business interruption, loss of data, or other scenarios, even if Genqiz, its providers, or licensors have been clearly informed of the possibility of such damages. In every instance, the total legal liability for all your claims against Genqiz, its providers, and licensors of Genqiz will not exceed the amount you actually paid to Genqiz within the 12 months prior to the date of the claim. Some legal jurisdictions might not permit the exclusion or limitation of legal liability for specific accidental or consequential damages, so some of the limitations mentioned may not be applicable to you. The parties mutually agree that Section 10 represents a fair risk distribution.

19. Declaration and General Assurance

You assert and assure that your utilization of the Service will adhere to Genqiz's Privacy Policy, in accordance with these Terms and Conditions, and will comply with all existing laws and regulations, encompassing but not limited to any local laws or regulations applicable in your country, state, city, or other governmental jurisdiction, pertaining to online conduct and acceptable content. This also encompasses all prevailing laws associated with data transmission in your country of residence, in addition to any other prevailing policies, terms, and conditions.

20. Term and termination

This Agreement remains valid for the duration of your use of a free or paid Genqiz account. Genqiz retains the right to end this Agreement or suspend your access to the Genqiz Service at any time, including instances of actual or suspected unauthorized use or non-compliance with the Agreement. If either you or Genqiz terminates the Agreement or if Genqiz suspends your access under the Agreement, you agree that Genqiz holds no legal or liability responsibility towards you and will not refund any payments made, to the fullest extent allowed by applicable law.

Any license provided to you within the Genqiz Subscription Package that hasn't terminated before your Subscription Package expires will end upon termination.

Through this document, you acknowledge and agree that the perpetual license granted by you to Genqiz for Public User Content (refer to the Public User Content section) will persist after the termination or expiration of any Agreement, regardless of the reason.

Sections of the Agreement, whether explicitly stated or inherent in their nature, remain effective even after termination, continuing to hold significance post-termination.
